Mass. Rapist Agrees to be Returned from Maine

Gary Alan Irving appeared in court in Portland on Monday on charges of being a charge of being a fugitive from justice.

PORTLAND, Maine (AP) _ A Massachusetts man who disappeared while awaiting sentencing for three rapes 35 years ago and was arrested last week in Maine has agreed to be returned to Massachusetts.

Gary Alan Irving appeared in court in Portland on Monday on charges of being a charge of being a fugitive from justice. He signed a waiver of extradition to return to Massachusetts. Maine State Police say he'll be taken to Massachusetts on Monday.

The 52-year-old Irving was living in Gorham outside Portland, married with a family and with a job installing telephones. Police said he was using the name Gregg Irving.

Irving has been on the Massachusetts Top 10 Most Wanted list for decades. He'd fled in 1979 while awaiting sentencing for three rapes in Norfolk County.

Editor's Note:  A pervious version of this story spelled Irving's name as Gary Allen Irving and said he fled in 1978.
