Fermented Lemonade Off-Limits to Minors, AG Determines

The beverage contains up to 0.5 percent alcohol, making it an alcoholic beverage under state statutes.

Maine's Attorney General's Office says a British lemonade is now off-limits to Mainers under the age of 21. The AG's Office says it's determined that under Maine law, Fentimans Victorian Lemonade is classified as an alcoholic beverage because it contains up to 0.5 percent alcohol. A bottle of table wine typically contains between 8 and 14 percent alcohol, and sometimes more.

The AG's determination stems from an incident in which a Houlton High School student brought a bottle of the lemonade to school, after having purchased it in a local store. The student consumed some of it before noticing that the label listed small amounts of alcohol.

The company that makes the product, Fentimans North America, says the drink is made with a natural fermentation process that creates small amounts of alcohol, and is generally classified as a soft drink.

Under Maine law, it's illegal to sell so-called imitation liquor to minors. They typically contain small amounts of alcohol, and sometimes imitate the look and smell of alcoholic drinks.
